In a recent personal injury case, our client was injured in a slip and fall on ice outside of a drycleaner. She principally suffered a concussion, which resulted in a traumatic brain injury that caused her to suffer confusion, vertigo, and other cognitive impairments.

A traumatic brain injury (TBI) occurs when an external mechanical force causes brain dysfunction. TBIs typically result from a violent blow to the head, or a sudden jolt to the body. Our client was a banker who received a large portion of her compensation in the form of bonuses. We were able to creatively argue that even though she didn't lose any income, she needed to be compensated for her lost bonus revenue due to the traumatic brain injury.

The insurance company disputed both liability and benefits, however, the case ultimately settled for $195,000 on the eve of the trial.
